Your purchase of the Draft Kit and use of the Website and other related pages on the CBSSports.com domain are also governed by the CBS Interactive Inc. (�CBSi�) Terms of Use (the CBSi Terms of Use), which can be found at https://www.cbsinteractive.com/legal/cbsi/terms-of-use, and incorporated herein by reference.

1. Other Sources of Terms and Conditions; Promotions and Coupons. In order to participate in or use certain services, promotions, discounts or coupons that may be run from time to time with respect to the Website (Offers), you may be required to agree to additional or different terms and conditions (Offer Terms). If there is a conflict between these Terms of Use and any Offer Terms, the Offer Terms shall control and the non-conflicting provisions in these Terms of Use will continue to apply. For example, if you seek to redeem a discount on the Website, your redemption of the discount is subject to the specific applicable Offer Terms and to the non-conflicting provisions of these Terms of Use. If an Offer does not contain Offer Terms, then only these Terms of Use apply.

3. Products, Content and Specifications. The inclusion of the Draft Kits on the Website does not imply or warrant that these products or services will be available at any particular time as products included on the Website may become unavailable. In the event the Draft Kit is unavailable or was listed at an incorrect price due to typographical error or error in pricing or other information, we will have the right to cancel orders of any such product, whether or not the order has been confirmed and/or your credit card or other payment method has been charged. If your credit card has already been charged for the purchase and your order is cancelled, we will refund any such charges within a commercially reasonable period of time after cancellation. In no event will anything contained in these Terms of Use or any area of the Website be construed as a representation or guarantee with respect to any content, services or products, including the Draft Kits. We reserve the right, without prior notice, to limit the order quantity on any product or service, to refuse service to any customer, or to cancel any order, including after it is submitted. We also may require additional verifications or other information prior to the acceptance and/or shipment of any order. Your receipt of an order confirmation from us does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. It also is your responsibility to ascertain and obey all applicable local, state, federal and international laws (including minimum age requirements) in regard to the possession, use and sale of any item purchased from the Website. By placing an order, you represent that the products ordered will be used only in a lawful manner, in accordance with all applicable laws, rules and regulations, including copyright law.

4. Free Shipping. All Draft Kit orders (the Orders) from the Website must be shipped to an address within the continental United States (the Delivery Area) (for purpose of clarity, this excludes Alaska and Hawaii). Orders will be delivered in ten (10) days with no additional charge for shipping and handling. The purchaser of the Order is solely responsible for selecting the appropriate shipping method, delivery dates and requests to expedite or cancel an Order . Wrongly made Orders will not be canceled and/or refunded, except at CBSi�s sole and exclusive discretion. Additionally, Orders that arrive folded, bent or otherwise damaged due to the delivery carrier and/or the purchaser's mail collection receptacle (for clarity, this includes mailboxes, P.O. boxes, mail slips and other mail collection devices) will not be canceled or refunded. With respect to the shipment of products and services sold through the Website, risk of loss and title for items purchased from the Website pass to you upon delivery of the items to the carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments.
